Dealing with insurance requirements is a pain, so why bother?
If someone gets hurt at an event you sponsor, they are likely to sue you. While RSGs have some insurance protection, you should always try to get protection from the contracted party responsible for the injury. You do this by requiring them to carry insurance and naming you an additional insured. The insurance company providing your protection expects you to do this any time you contract with someone.
Another reason this is a good idea is the insurance policy providing your protection has a number of exclusions. If the loss is excluded then you rely on the contracted party to protect you.
Is there a real risk here? Yes, there is. The university does not protect you. Your RSG is not a legal entity so, if a suit is filed, it will be filed against the members of the RSG. Each member of the group could end up in a courtroom and hiring a lawyer. It’s far better to require the people you are contracting with to have insurance.
As a service to you, INLOCC will review the certificate of insurance. You can
- Email it to Kutina England
- FAX it to 812-855-9320, ATTN: Kutina England
- Mail to to INLOCC, ATTN: Kutina England, Smith Research Center 110 | 2805 E. 10th St., Bloomington, IN 47408
We must have a contact email address for you.
What insurance should you require? Please tell the contracted party to go to this page and follow the guidelines found below. You must provide them with the information for the Certificate Holder and Additional Insured.
We ask that the Trustees of Indiana University also be named as an additional insured. Plaintiffs use a shotgun approach, naming everyone in sight, and the university will be within sight, even though we are not responsible for your RSG.
